End-of-service gratuity represents a critical financial lifeline for departing expatriate employees. You need to understand exactly how the law calculates this payment. Ignorance costs you money when you sign final settlement documents. Oman’s Labour Law establishes a clear minimum standard for your gratuity. Article 61 currently governs workers not yet covered by the Social Protection Law. The government requires employers to pay at least one basic monthly wage for every year of service. The calculation uses your final basic wage, not your starting salary. Partial years of service also count towards your final payout. If you work five and a half years, you receive five and a half months of basic salary. The law calculates this based strictly on the basic wage listed in your contract.

If your contract promises a higher multiplier, the company must honor that agreement. The law prioritizes whichever agreement benefits the worker the most. Your years of service prior to the new 2023 Labour Law still count completely. Do not let an employer claim your older service years vanished. Some companies operate private savings or retirement schemes for their employees. These approved schemes can replace the statutory gratuity if they pay an equal or higher amount.

Preparing For The New Provident Scheme

The Ministry of Labour plans to launch a new Provident Scheme in 2027. This new system will replace the current employer-paid gratuity model for expatriates. The government will require employers to fund individual savings accounts for foreign workers. Until that system launches, Article 61 remains your primary legal protection. Always demand an official end-of-service certificate before you leave the company. Employers must provide this document completely free of charge upon request. Review your final salary, unused leave, and gratuity calculations carefully. Submit any disputes directly to the Ministry of Labour within one year. Failing to file a claim within one year voids your legal rights. You cannot wait indefinitely to chase down unpaid gratuity funds.
